Introduction
Amplify USA (“Amplify,” “we,” “us,” or “our”) operates a technology platform designed to provide users with information concerning elected officials, public policy, and civic engagement tools, including related features, content, and functionality (collectively, the “Platform” or “App”).
We are committed to protecting the privacy, confidentiality, and security of the information entrusted to us. This Privacy Policy describes the types of information we collect, the manner in which such information is collected, used, maintained, disclosed, and safeguarded, and the choices and rights available to users regarding their information. This Policy applies to information collected through our website located at www.amplify-usa.com, as well as through any mobile, web-based, or other applications, products, or services operated or made available by Amplify (collectively, the “Services”).
This Privacy Policy forms part of and is incorporated into the terms governing your access to and use of the Services. By accessing, downloading, registering for, or otherwise using the Services, you acknowledge that you have read, understand, and agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, you must not access or use the Services.

Definitions
“Personal Data” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable individual. Personal Data includes, without limitation, information such as names, contact information, identifiers, online identifiers, device identifiers, account credentials, geolocation data, and any other information that, alone or in combination with other data, can be used to identify or distinguish an individual.
“Usage Data” means information automatically generated or collected through an individual’s access to or use of the Platform or Services that does not, on its own, identify a specific individual. Usage Data may include, without limitation, technical information and metadata such as browser type, operating system, device characteristics, Internet Protocol (IP) address, pages or screens viewed, features used, access times, referring and exit URLs, interaction patterns, and other analytical or diagnostic information collected in an aggregated, de-identified, or anonymized form.

You are not required to provide a phone number unless a specific feature requires it.
B. User-Generated Content
If you choose to submit, post, upload, or otherwise make available any content or information in public or publicly accessible areas of the Platform (including, without limitation, forums, message boards, chat features, comment sections, or directories), such content may be viewed, collected, copied, shared, or otherwise used by other users of the Platform or by third parties. Any information you disclose in these public areas is disclosed voluntarily and at your own risk.
Amplify USA does not control, monitor, or assume responsibility for how other users or third parties access, use, store, or disseminate information that you choose to make public, and we cannot guarantee that such information will not be misused or disclosed in ways that you did not intend. By posting content in public areas of the Platform, you acknowledge and agree that Amplify USA shall not be responsible or liable for any use, misuse, or disclosure of such information by third parties.
C. Information Collected Automatically
When you access or use the Services, Amplify USA may automatically collect certain information related to your interaction with the Platform, your device, and your network environment. This information is collected through automated means and is used to operate, maintain, secure, and improve the Services, as well as to analyze usage trends and enhance user experience.
The information we collect may include log and technical data such as your Internet Protocol (IP) address, browser type and version, access dates and times, pages or features viewed or accessed, and the URLs or websites that referred you to the Platform. We may also collect device-related information, including unique device identifiers, operating system type and version, browser characteristics, network or carrier information, and other technical identifiers associated with the device you use to access the Services.
In addition, we may collect usage and interaction data reflecting how you engage with the Platform, including frequency and duration of use, navigation patterns, and interactions with Platform features, such as engagement with information relating to elected officials or civic tools made available through the Services. This Usage Data is generally collected in an aggregated or de-identified manner and is used for analytics, performance monitoring, and service optimization.
If you access or use the Services across multiple devices, we may associate or link information collected from those devices in order to provide a consistent, personalized, and seamless experience across platforms, to improve functionality, and to support security and fraud-prevention efforts, to the extent permitted by applicable law.

Cookies and Tracking Technologies
We use cookies, web beacons, pixels, software development kits (SDKs), and other similar tracking technologies (collectively, “Cookies and Tracking Technologies”) to support the operation, functionality, and security of the Platform, to remember user preferences, to analyze usage and performance, and to improve and customize the user experience. These technologies enable us to recognize your browser or device, maintain session continuity, understand how users interact with the Services, and identify and resolve technical issues.
You may manage or disable Cookies and Tracking Technologies through your browser or device settings. However, please note that disabling or limiting the use of cookies or similar technologies may impair the availability, performance, or functionality of certain features of the Platform, and some portions of the Services may not function properly or as intended as a result.

How We Use Information
We use Personal Data and Usage Data for legitimate business and operational purposes, including to provide, operate, administer, and maintain the Services; to authenticate users and manage accounts; to personalize content, features, and user experiences; to respond to inquiries, requests, and support communications; and to deliver important service-related, administrative, or account-level notices.
We also use such information to monitor, analyze, and improve the performance, functionality, security, and reliability of the Platform; to conduct internal analytics, research, and development; to detect, prevent, and address fraud, abuse, security incidents, or technical issues; to enforce our Terms of Use and other agreements; to protect our legal rights, interests, and the rights of others; and to comply with applicable laws, regulations, legal processes, and governmental requests.

Optional Data Sharing With Utah Citizens for the Constitution
At certain points within the Platform, users may be presented with an optional, affirmative consent mechanism, such as a checkbox, through which they may voluntarily authorize Amplify USA to share specified Personal Data with Utah Citizens for the Constitution. Such authorization is entirely optional and is provided solely at the user’s discretion. Only users who knowingly and affirmatively select this option will be deemed to have consented to the disclosure of their information.
Where a user provides such express authorization, the information shared may be limited to the Personal Data voluntarily submitted by the user in connection with that consent, which may include the user’s name, mailing address, email address, and telephone number, to the extent such information has been provided. Users who do not select or affirmatively opt into this authorization will not have their Personal Data disclosed to Utah Citizens for the Constitution.
A user’s decision to opt in or opt out of this data-sharing authorization does not condition, restrict, or otherwise affect the user’s ability to access or use the Platform or its core features. Amplify USA does not sell or rent Personal Data, and does not disclose Personal Data to Utah Citizens for the Constitution except where a user has provided clear, affirmative, and informed consent as described above, or as otherwise required by applicable law.

Third-Party Disclosures
Amplify USA may disclose or share Personal Data only in limited circumstances and solely as reasonably necessary to operate the Platform, comply with legal obligations, or carry out authorized user requests. Such disclosures may occur with the following categories of recipients:
First, we may share Personal Data with third-party service providers, vendors, consultants, or agents that perform services on our behalf, such as hosting, data storage, analytics, customer support, security, or technical operations. These service providers are contractually obligated to process Personal Data solely for the purposes of providing services to Amplify USA and to implement appropriate administrative, technical, and physical safeguards to protect such data.
Second, we may share Personal Data with affiliated, aligned, or partner organizations, but only where a user has provided clear, affirmative, and informed consent to such sharing, and only to the extent authorized by the user at the time consent is given.
Third, we may disclose Personal Data to governmental, regulatory, law enforcement, or judicial authorities where required to do so by applicable law, regulation, subpoena, court order, or other valid legal process, or where we reasonably believe such disclosure is necessary to protect the rights, property, or safety of Amplify USA, our users, or others.
Finally, we may transfer or disclose Personal Data as part of a corporate transaction, including a merger, consolidation, reorganization, acquisition, sale of assets, or similar transaction, in which case Personal Data may be transferred to a successor or acquiring entity subject to appropriate confidentiality and data-protection obligations.
Amplify USA does not sell Personal Data, does not share Personal Data for purposes of targeted or cross-context behavioral advertising, and does not otherwise disclose Personal Data except as expressly described in this Privacy Policy or as permitted by applicable law.

Data Retention and De-Identification
Users may request deactivation of their account and de-identification of associated Personal Data by contacting Amplify USA at info@amplify-usa.com. Upon completion of the de-identification process, Personal Data that directly identifies the user will be permanently and irreversibly removed or replaced with non-identifying, randomized identifiers, and the user’s account will be permanently deactivated and no longer accessible.
Following de-identification, Amplify USA may retain certain Usage Data in an aggregated, anonymized, or de-identified form for legitimate business purposes, including analytics, fraud prevention, security monitoring, and maintenance of system integrity. Notwithstanding the foregoing, Amplify USA may retain limited categories of information to the extent required or permitted by applicable law, regulation, legal process, or enforceable governmental request, or as reasonably necessary to resolve disputes, enforce agreements, or comply with legal obligations.

Your Rights and Choices
You may exercise certain rights with respect to your Personal Data, including the ability to access and update your account information, request de-identification or deletion of Personal Data, and opt out of receiving promotional or non-essential communications. Requests to exercise these rights may be submitted by contacting Amplify USA at info@amplify-usa.com, and we will respond in accordance with applicable law and our internal policies.

Security
We implement and maintain reasonable and appropriate administrative, technical, and physical safeguards designed to protect Personal Data against unauthorized access, disclosure, alteration, or destruction, taking into account the nature of the information and the risks associated with its processing. Despite these efforts, no method of data transmission over the Internet or method of electronic storage can be guaranteed to be completely secure, and accordingly, any transmission of information to or through the Services is undertaken at the user’s own risk. In the event of a data security incident or breach involving Personal Data, Amplify USA will take commercially reasonable steps to investigate and mitigate the incident and will provide notice to affected individuals and applicable authorities as required by law.

Children’s Privacy
The Services are intended solely for use by individuals who are at least eighteen (18) years of age. Amplify USA does not knowingly collect, solicit, or process Personal Data from children or minors under the age of eighteen. If we become aware that Personal Data has been collected from an individual under eighteen, we will take commercially reasonable steps to promptly delete or de-identify such information and to prevent further collection, in accordance with applicable law.

Anonymous and Aggregated Data
We may collect, generate, and use information in aggregated, anonymized, or de-identified form for legitimate business purposes, including analytics, research, reporting, and the improvement, development, and optimization of the Services. Such information does not identify, and cannot reasonably be used to identify, any individual, and may be derived from Personal Data only after such data has been irreversibly anonymized or de-identified in accordance with applicable law. Aggregated or anonymized data may be used internally and, where appropriate, shared with third parties for lawful purposes, provided that such data does not permit the identification of any individual.

Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, Amplify USA expressly disclaims all warranties, representations, and conditions, whether statutory, express, or implied, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, or that the Services will be uninterrupted, error-free, or secure.

Limitation of Liability
To the fullest extent permitted by applicable law, Amplify USA shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including, without limitation, damages for loss of profits, loss of data, loss of goodwill, business interruption, or other intangible losses, arising out of or relating to the access to, use of, or inability to use the Services, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Amplify USA has been advised of the possibility of such damages.

Changes to This Policy
Amplify USA may modify or update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or business operations. When we make material changes to this Privacy Policy, we will provide notice by posting the updated policy on the Platform at least thirty (30) days prior to the effective date of such changes, or by such other reasonable means as may be required by applicable law. Continued access to or use of the Services after the effective date of any updates constitutes acceptance of the revised Privacy Policy.

Terms & Conditions – Content Restrictions
Users and groups are prohibited from using the Platform to advocate for, promote, endorse, or facilitate legislation, public policies, campaigns, or initiatives that are pornographic, obscene, vulgar, or violent in nature, or that promote pornography, violence, sexual exploitation, abuse, or the degradation of persons. Content or activity that seeks to normalize, encourage, or advance such conduct is inconsistent with the purposes of the Platform and is not permitted.
In addition, the Platform may not be used to promote legislation or policies that undermine the sanctity of the family or the inherent dignity of innocent human life beginning at conception, or that otherwise conflict with principles of natural law or the constitutional law of the United States. Amplify USA reserves the right, in its sole discretion, to review, restrict, remove, or take other appropriate action with respect to content or activity that violates these standards, and to enforce these requirements in furtherance of the Platform’s mission and governing policies.
